Privacy policy

EAT APPLICATION DMCC ("Eat App" or “Us” or “We” or “Our”), along with its subsidiaries and affiliated companies, is committed to safeguarding privacy of the representatives of the Venue (“Registered Users”) and patrons of Venues (“Guests”) (Registered Users and Guests shall individually and collectively be referred to as “You” or Your”). This Privacy Policy (the “Policy”) describes Eat App's policies and procedures regarding the collection, use, and disclosure of the information collected through the Eat App website, www.eatapp.co, mobile applications, and other affiliated websites owned and operated by Eat App (“Site”) (the Site, and any products and services provided by Eat App are collectively referred to as the "Services," which includes the Platform, as defined below). By using Our Site or Services, You agree to the terms of this Policy.

Please read the Policy carefully before using or registering on the Site, accessing any material or information, or availing of any Services through the Site. This Policy (i) will be considered to be an electronic record under the Indian data privacy laws, including the Information Technology Act, 2000, read with rules and regulations made thereunder; (ii) will constitute a ‘Notice’ under the Digital Personal Data Protection Act, 2023 when applicable, read with rules and regulations made thereunder; and (iii) will not require any physical, electronic, or digital signature by Eat App.

1. Eat App Service Overview.

Each of the restaurants and other locations that have signed up to the Service (a “Venue”) has adopted Eat App's proprietary reservation and inventory management system (the “Platform"). The Platform interacts with the Venue to find available reservations, to secure, change or cancel online reservations, and to confirm that reservations were honored. Where reservations are placed directly with a Venue that uses the Platform, or through other third-party reservation services that the Venue may use, information about Guests is recorded in (or transferred to) the Platform (either directly by the Venue or through third party integrations with the Platform facilitated by the Venue) to assist the Venue in managing the reservation and provide services to such Guest. While an individual Venue’s reservation inventory is accessible to the Platform to perform these functions, other information that may be stored by a Venue or its channel partners or payment service providers (for example, credit card numbers) is not accessible to the Platform. Where a Guest may pay or enter payment information via the Platform (either to hold a reservation, or for services received at a Venue), payment is processed by third-party payment processors  and information about that payment is subject to such processor’s policies. Note that in no case does Eat App store credit card or payment information on the System; all such information is held by Our third-party payment processor(s) or the Venue itself.

2. Types of Data We Collect.

“Personal Data” means data that allows someone to identify or contact You, including, for example, Your name, address, telephone number, e-mail address, as well as any other nonpublic information about You that is associated with or linked to any of the foregoing data or that may independently, or in connection with other information, be used to identify You.

“Anonymous Data” means data that is not associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons.

We collect Personal Data and Anonymous Data, as described below.

A Note on Users. Eat App customers are the Venues (or agents that Venues have contracted to handle their reservations), and only Venue employees or agents have Accounts (as defined below) with Eat App. Guests do not have Accounts on the Platform. Except where provisions are specific to Registered Users, Accounts, or Guests, all the terms of this Policy apply equally to both Guest and Registered User information. Where relevant to the Guests, and where this Policy is intended to be applicable to the Guests, Eat App shall specifically require the Guests to agree to this Policy in a clear and distinct manner to make it binding and enforceable. All responsibility in this regard shall vest solely with Eat App and it shall be Eat App’s responsibility to obtain such Guests’ consent in a manner compliant with applicable law.

Information You Provide to Us.

  • We may collect Personal Data from You, such as Your first and last name, gender, e-mail and mailing addresses, and password when You create an account to use the Services (“Account”). Only Registered Users, representatives of a Venue may create an Account .
  • If You access the Services on Your mobile device, We may collect Your phone number and the unique device id number (Registered Users only).
  • When connecting to Our Services via a service provider that uniquely identifies Your mobile device, We may receive this identification and use it to offer extended services and/or functionality (Registered Users only).
  • If You provide Us feedback or contact Us via e-mail, We will collect Your name and e-mail address, as well as any other content included in the e-mail, in order to send You a reply.
  • If You participate in a survey conducted via the Services, We may collect additional profile information which includes [•].
  • We may also collect Personal Data at other points on Our Site or Services that state that Personal Data is being collected, provided that the purpose for such collection is disclosed to You, and consent for processing is taken by Us.

Information Collected from Third Parties.

  • When a Venue takes a reservation directly from a Guest, or receives such information relating to a third-party service or platform (i.e., Google, Yelp), Personal Data about the Guest is recorded in the Platform. In addition, Guest notes (such as dining preferences) may be recorded in the Platform by Venue staff.
  • When a Guest makes a financial transaction with a Venue via the Platform, as envisaged in Clause 1, We will facilitate collection of all information by payment processors necessary to complete the transaction, including credit card information. We do not store payment information directly on Our servers, but this information may be shared by payment processors with Venues and third parties as set forth herein.
  • Purchase histories of Guests may be linked to the Platform by the Venue point of sale systems.

Information Collected via Technology.

  • Information Collected by Our Servers. To provide Our Services effectively, and to issue promotions to You in relation to any offers or functionalities, , Our servers (which may be hosted by a third-party service provider) collect information from You, including Your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to Your computer when You use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for Your visit.
  • Log Files. As is true of most websites, We gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to analyze trends, administer the Site, track users’ movements around the Site, gather demographic information about Our user base as a whole, and better tailor Our Services to Our users’ needs. For example, some of the information may be collected so that when You visit the Site or the Services again, it will recognize You and the information could then be used to serve advertisements and other information appropriate to Your interests. Except as noted in this Privacy Policy, We do not link this automatically-collected data to Your Personal Data.
  • Cookies. Like many online services, We use cookies to collect information. “Cookies” are small pieces of information that a website sends to Your computer’s hard drive while You are viewing the website. We may use both session Cookies (which expire once You close Your web browser) and persistent Cookies (which stay on Your computer until You delete them) to provide You with a more personal and interactive experience on Our Site. Site areas accessible only to Registered Users require that Your browser accept Cookies. Eat App uses Cookies to verify that You are properly signed in, to display information for Your primary location, and to highlight Your pending reservations, for example. We may also use Cookies from time to time to measure Your response to new aspects of the Services and/or emails in an effort to continually improve customer service and Services usability. Please be aware that a Cookie cannot spread computer viruses, retrieve any other data from Your hard drive, or capture Your email address. You can erase or block Cookies from Your computer if You wish to do so (Your internet browser help screen or manual will thoroughly explain this process), but certain parts of the Services, as well as parts of the Site, may not work correctly or will not work at all if Your browser is set not to accept Cookies. The Site may contain electronic images (called a "single-pixel GIF" or "web beacon") that are used to count users who have visited that page, or to access certain cookies.
  • How We Respond to Do Not Track Signals. We do not currently respond to “do not track” signals or other mechanisms that might enable Users to opt-out of tracking on Our Site.
  • Mobile Services. (Registered Users only). We may also collect non-personal information from Your mobile device if You have downloaded Our mobile application (the “Application”). This information is generally used to help Us deliver the most relevant information to You. Examples of information that may be collected and used include Your geographic location, how You use the Application, and information about the type of device You use. In addition, in the event Our Application crashes on Your mobile device, We will receive information about Your mobile device model software version and device carrier, which allows Us to identify and fix bugs and otherwise improve the performance of Our Application. This information is sent to Us as aggregated information and is not traceable to any individual and cannot be used to identify an individual.
  • Analytics Services. In addition to the tracking technologies We place, other companies may set their own cookies or similar tools when You visit Our Site. This includes third-party analytics services, such as Google Analytics (“Analytics Services”), that We engage to help analyze how users use the Site, as well as third parties that deliver content or offers. We may receive reports based on these parties’ use of these tools on an individual or aggregate basis. We use the information We get from Analytics Services only to improve Our Site and Services. The information generated by the Cookies or other technologies about Your use of Our Site and Services (the “Analytics Information”) is transmitted to the Analytics Services. The Analytics Services use Analytics Information to compile reports on user activity. The Analytics Services may also transfer information to third parties where required to do so by law, or where such third parties process Analytics Information on their behalf. Each Analytics Services’ ability to use and share Analytics Information is restricted by such Analytics Services’ Terms of Use and Privacy Policy. By using Our Site and Services, You consent to the processing of data about You by Analytics Services in the manner and for the purposes set out above. We may also partner with ad companies to support Our marketing efforts, including by serving You ads better tailored to Your likely interests. If You don’t want to take advantage of these services, You may be able to opt-out by visiting http://www.aboutads.info/ or if You are located in the EU, http://www.youronlinechoices.eu/. 

3. Use of Your Data.

3.1 By Eat App.

Personal Data. In general, Personal Data You submit to Us is used either to deliver the Services or respond to requests that You make. We use Your Personal Data in the following ways:

  • Facilitate the creation of and secure Your Account (Registered Users only)
  • Identify You as a user of the Services
  • Provide improved administration of Our Site and Services
  • Provide the Services You request, including by communicating this information to the applicable Venue
  • Improve the quality of experience when You interact with Our Site and Services
  • Send Guests email and SMS text confirmations and other communications, like reminders, for each of Your reservations. Venues may also use the Platform to send such messages directly to Guests
  • Send You administrative e-mail notifications, such as security or support and maintenance advisories (Registered Users only)
  • Respond to Your inquiries related to employment opportunities or other requests such as those pertaining to feedback;
  • Send newsletters, surveys, offers, and other promotional materials related to Our Services and for other marketing purposes of Eat App. (Registered Users only)

Anonymous Data. We may create Anonymous Data records from Personal Data of both Guests and Registered Users by excluding information (such as Your name and phone number) that makes the data personally identifiable to You. We use this Anonymous Data to analyze request and usage patterns so that We may enhance the content of Our Services and improve Site navigation. We reserve the right to use Anonymous Data and aggregated and other de-identified information for any purpose and disclose Anonymous Data to third parties in Our sole discretion.

3.2 By Venues.

When a reservation is made using Our Services,  Guest name is provided to the applicable Venue, just as would occur if You were making a reservation over the phone. Your email address and phone number is also provided to the Venue in case the Venue needs to contact You regarding your reservation. Your special preferences or comments regarding Your reservation may also be provided, which vide the Services will be passed on to that Venue. And if You are interested in receiving promotional or other communications from the Venue You may “opt-in” to receive such communications from the Venue, either via the Platform or directly, as applicable, and subject to such Venue’s marketing policies, as set forth below.

Eat App will only share the information specified above with the Venue at which a Guest has made reservations using the Service. Venues cannot use the Services to access information pertaining to Guests, reservations, or related information from other Venues, except that Venues with the same corporate ownership may elect to share such information.

Venues primarily use reservation information provided through the Services to secure and manage reservations. Additionally, as noted above, if You have given permission to a Venue to communicate with You, the Venue may do so, subject to the Venue’s policies and procedures, including those relating to the storage and management of Personal Data.

Venues want to provide You with the best possible service so that You will visit them again. As noted above, Venues may use the Platform to record purchases via integration with POS systems and to take note of Your special requests, allergies, special occasions, or other pertinent information that will help the Venue serve You better during Your next visit. If a Venue chooses to note Your preferences, that information may be typed into the Platform manually, just as a Venue might write a note on an index card. This data belongs to the Venue, since it is a product of that Venue’s relationship with You. As mentioned in Section 3.1 above, We may aggregate such preference information and Guest notes into Anonymous Data. Eat App also creates backup copies of all information stored on the Platform for each Venue, to assist in the restoration process in the event of data loss.

Each Venue is a separate business from Eat App. While Eat App encourages Venues to comply with data protection requirements, Eat App will not be responsible for a Venue’s failure to comply with laws applicable to the use of Personal Data. Any complaints or inquiries regarding the use of Your information by a Venue, or marketing communications from a Venue, should be addressed directly to the Venue in question.

In no event will Eat App be responsible for information, management, and use of data collected by Venues from their own websites and not stored on the Services.

3.3 Third Parties.

We disclose Your Personal Data as described below and as described elsewhere in this Policy.

Service Providers. We may share Your Personal Data with third-party service providers to: provide You with the Services; to conduct quality assurance testing; to facilitate the creation of Accounts; to provide technical support; and/or to provide other services to the Eat App. We use third-party payment processors, to process payments made through the Platform to Venues. In connection with the processing of such payments, We do not retain any personally identifiable information or any financial information such as credit card numbers. Rather, all such information is provided directly to these third-party payment processors, whose use of Your personal information is governed by their privacy policies.

Social Networking Sites. We allow Guests to place reservations with Venues on the Platform via social networking sites (e.g., Facebook or Twitter, and each an “SNS”). Guests who access the Platform via an SNS (i.e., by choosing to “sign in via Facebook” or the equivalent) consent to Eat App receiving information required to make the reservation from the SNS. The Platform may also enable You to post content to an SNS. If You choose to do this, We will provide information to such SNS in accordance with Your elections. You agree that You are solely responsible for Your use of an SNS and that it is Your responsibility to review the terms of use and privacy policy of such SNS. Any information that We collect from an SNS account will depend on the privacy settings You have with that SNS, so please consult the SNS’s privacy and data practices. We will not be responsible or liable for: (i) the availability or accuracy of such SNS; (ii) the content, products, or services on or availability of such SNS; or (iii) Your use of any such SNS.

Affiliates. We may share some or all of Your Personal Data with our parent company, subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we will require Our Affiliates to honor this Privacy Policy.

Corporate Restructuring. We may share some or all of Your Personal Data in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving the sale, transfer, divestiture, or disclosure of all or a portion of Our business or assets. In the event of an insolvency, bankruptcy, or receivership, Personal Data may also be transferred as a business asset. If another company acquires Our company, business, or assets, that company will possess the Personal Data collected by Us and will assume the rights and obligations regarding Your Personal Data as described in this Privacy Policy.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. Communications and Disclosures.

From Eat App.

Eat App sends automated service messages to Guests via email and/or text pertaining to upcoming or recent Venue reservations or other core functions of the Services, such as confirmations, reminders, and/or invitations to provide customer feedback (“Service Communications”). In addition, Guests and Registered Users may also opt-in to receive promotional notices, special offers, and other related information from Eat App (“Marketing Communications”). You may always unsubscribe from Marketing Communications. However, so long as You use the Service, We may send essential Service Communications to the contact information associated with Your Account.

From Venues.

Venues may independently use the Platform to send Guests Service Communications and, if opted in by a Guest, Marketing Communications. Communications sent directly from a Venue via the Platform are subject to this Policy, but communications sent by a Venue outside of the Platform are subject to the Venue’s policies and practices.

Third Parties.

Eat App will never sell, rent, loan, or otherwise distribute any of Your personal information (including but not limited to Your name, email address, phone number, or any other identifiable information about You) to any third party except as set forth in this Policy without Your prior, express written consent.

Legally Mandated Disclosure.

Notwithstanding anything to the contrary in this Policy, Eat App may be required to disclose Personal Information in response to inquiries by formal law enforcement, or in cases permitted by the United States’ CAN-SPAM Act of 2003 (CAN-SPAM), the European General Data Protection Regulation and its implementing laws, Japan's Personal Information Protection Act, Information Technology Act, 2000 and the rules issued thereunder, Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the rules issued thereunder, or other laws governing the use and disclosure of Personal Information.

5. Accounts.

Registered Users can view and manage their Account information, including any associated Personal Data, by clicking on the "Account" link at the top of the login page. Guests and Registered Users may at any time contact Eat App at support@eatapp.co or as set forth in Section 10 to request that all Personal Data be deactivated.

6. How Eat App Protects Data.

Eat App uses a state-of-the-art, multi-layer encryption algorithm and makes its best efforts to ensure that all of Your Personal Data and Account information is secure. Eat App stores all Personal Data on secure servers. Eat App continually monitors and implements changes and improvements that become available in the electronic data security industry to maintain the security of Personal Data in Our possession.

7. A Note About Children.

We do not intentionally gather Personal Data from visitors who are under the age of 18. If We learn that a child under the age of 18 has submitted Personal Data to Eat App, We will attempt to delete such data as soon as possible. If You believe that We might have any Personal Data from a child under 18, please contact Us at support@eatapp.com or as set forth in Section 10.

8. Changes to this Policy.

Any changes to this Policy will always be posted to this page of the Site, along with the effective date of the updated Policy. You should check this page periodically to stay abreast of any such changes. Eat App will never make changes to the Policy that violate any applicable privacy laws. For any material changes to the Policy, We will notify You via email or by placing a prominent notice on the homepage of Our Site. You will be required to provide Your consent and acceptance to the updated Policy before You can continue accessing the Site and the Services after such change.

9. Disclosure, Correction, Control of Personal Data.

If You wish to have Eat App disclose what Personal Data of Yours it holds, and/or how Eat App obtained such information, or if You desire the correction, suspension of use, or to be informed of the purpose of use of Personal Data by Eat App, please contact Eat App as set forth below. Eat App will process such a request in compliance with all applicable privacy laws, but may first confirm that such a request has been made by You personally.

10. GDPR COMPLIANCE

10.1. Data Subject Rights.

Guests and Registered Users have the right to access, rectify, or delete their Personal Data, as well as the right to data portability and to restrict processing. Requests can be made by contacting support@eatapp.co.

10.2. Lawful Basis for Processing.

Eat App processes Personal Data based on consent, contractual necessity, and legitimate interests, ensuring compliance with GDPR requirements.

10.3. Data Protection Officer (DPO).

Eat App has appointed a Data Protection Officer (DPO). For any data protection concerns or inquiries, contact the DPO at dpo@eatapp.co.

11. BREACH NOTIFICATION

11.1. Breach Notification.

In the event of a data breach, Eat App will notify the relevant supervisory authority within 72 hours of becoming aware of the breach, unless the breach is unlikely to result in a risk to the rights and freedoms of individuals. If the breach is likely to result in a high risk to the rights and freedoms of individuals, Eat App will also inform the affected individuals without undue delay. Notwithstanding anything contained herein, to the extent the breach pertains to any Personal Data of individuals located in India, or any Personal Data processed outside India if such processing is in connection with any activity related to offering of goods or services to You within the territory of India, Eat App shall make breach reporting to the Data Protection Board of India and You within such timelines as may be prescribed under applicable laws. 

12. DATA TRANSFERS

12.1. International Data Transfers.

Eat App ensures that any Personal Data transferred outside the European Economic Area (EEA) is protected by appropriate safeguards, such as Standard Contractual Clauses (SCCs), approved by the European Commission, or by ensuring that the country provides an adequate level of data protection.

13. DPDP ACT COMPLIANCE

13.1 Grounds for processing

Consent: In most cases, We will process Your Personal Data based on Your prior explicit consent as required under Indian law, which You can withdraw at any time. Please refer to Section 2 above to understand the different instances in which We collect Your Personal Data and the purposes for which We process Your Personal Data. While You have the right to withdraw the consent that You have given, certain Personal Data may be necessary to provide You with a Service and We may not be able to provide You with a Service or certain Site features if the Personal Data requested is essential for the Service. 

Notwithstanding anything contained herein, We may, in compliance with applicable laws in India, process Your Personal Data without obtaining Your consent in the event: (a) You voluntarily provide Your Personal Data to Us and do not indicate anything to show that You do not consent to the use of such Personal Data by Us. Specifically, this will involve situations when You fill out a form to (i) contact Us; and (ii) request information about Our services, (iii) subscribe to Our communications, (iv) participate in promotions or surveys, or (v) otherwise voluntarily provide Us Your personal information. Further, if You voluntarily provide Us Your Personal Data for any of the purposes stated above, We shall not process Your Personal Data for any of the other purposes, unless You specifically voluntarily provide Us Your Personal Data for any and/or all of the other purposes; (b) the purpose of processing is for fulfilling any legal obligation to disclose any information to the State or any of its instrumentalities subject to such processing being in accordance with the provisions regarding disclosure of such information in any other law for the time being in force; (c) it is for employment purposes or for defending ourselves from any loss or liability in the context of employment;  (d) it is for compliance with any judgment, decree, or order issued under any Indian law or any judgment, decree, or order relating to civil contractual claims under any foreign law; (e) it is for responding to a medical emergency involving a threat to the life or immediate threat to Your health or of any other users’ health; (f) it is for taking measures to provide medical treatment or health services to You or any other Registered User or Guest during an epidemic, outbreak of disease or any other threat to public health; (g) it is for the purpose of taking measures to ensure safety of, or provide assistance or services to, any individual during any disaster, or any breakdown of public order and (h) it is in the interest of prevention, detection, investigation or prosecution of any offence or contravention of any law for the time being in force in India.

13.2. Your Rights

We provide You with the following rights about Your Personal Data as per the applicable law. Your rights are: 

Right to access information: You have the right to ask Us: (a) for a summary of Your Personal Data being processed by Us and the processing activities undertaken by Us with respect to such Personal Data; (b) the identities of all other third-party entities with whom Your Personal Data has been shared by Us, along with a description of the Personal Data so shared. However, this right has certain limitations as prescribed under applicable law. 

Right to modify/rectify information: You have the right to correct or update any information, including Your Personal Data. In the event that You notice that any Personal Data already provided by You is inaccurate or incomplete or needs to be updated, You can ask Us to rectify such Personal Data (if the same cannot be done at Your end online) by contacting us via email at support@eatapp.co. Further, if any Personal Data already provided by You is inaccurate, incomplete, or outdated, then You must give Us the accurate, complete, and up-to-date Personal Data by writing to Us at the email ID provided above, and We shall accordingly rectify such Personal Data at Our end. We urge You to ensure that You always provide Us with accurate and correct information/data to ensure that Your use of Our Services is uninterrupted. In case of any such modification of Personal Data, You may be required to furnish supporting documents relating to the change in Personal Data for verification.  

Right to erasure: You have the right to request the deletion or removal of Your Personal Data where there is no compelling reason for Us to keep it. Such right of erasure can be exercised by writing to Us at support@eatapp.co, which must be in a format prescribed by the government, when available. For now, You may write to Us on the above email, to exercise this right. On such an erasure request, We shall delete all of Your Personal Data stored by Us. We shall also ensure that any third-party service provider processing Your Personal Data on Our behalf deletes all Your Personal Data, unless retention of the same is necessary for providing the Services or for compliance with any applicable law for the time being in force. Please note that We may not be able to allow You access to Our Website and/or provide Services, subsequent to Your exercising of this right.

Right with respect to consent: In certain instances, before collecting Your Personal Data, We take Your free, specific, informed, unconditional, unambiguous, and explicit consent. You can deny consent for the use of any particular information or revoke the consent already given. You shall have the following rights about Your Personal Data collected by Us:

Deny Consent: You shall have the right to deny a request for consent for (a) collection and processing of specific Personal Data; (b) disclosure of such Personal Data to any third parties; and (c) retention of such Personal Data (except when the same is required to be retained under applicable laws). However, any such denial will not prejudice Our rights or the rights of Our partners to retain any Personal Data that You have provided in relation to the Services already availed by You through the Site, or by any third-party service providers, per the provisions of this Policy. Further, in case of a denial of a request for consent, the Site does not guarantee the continued facilitation of a Service. 

Withdraw Consent: You may also choose to withdraw Your consent (including consent provided for the processing of Your Personal Data by Us or by any third party on Our behalf) supplied to the Site at any point in time. To withdraw Your consent for the use, processing, disclosure, sharing or transferring of any Personal Data, You may raise a request on the Site or mail Us at support@eatapp.co and/or alternatively, click on the “I would like to withdraw my consent” link provided to You in the email sent by Us. You shall also have the right to withdraw consent to the collection of cookies by writing to Us at support@eatapp.co. However, please note You will not be able to withdraw consent to the collection of necessary cookies, which enables Us to display the Site on Your browser. Your withdrawal of the consent will not affect the lawfulness of processing of Personal Data based on Your consent before its withdrawal. In such an event, You are responsible for the consequences of such withdrawal of consent, and We do not provide a guarantee of Services if any such option to withdraw consent is exercised. 

If You do not provide Your consent or later withdraw Your consent for any purposes which are essential for providing the Services to You, We will be unable to continue providing You the Services on the Site. In such a scenario, We may delete Your Personal Data or other information We had earlier collected and stored, or de-identify it so that it is anonymous and not attributable to You. 

Upon receiving a request for deletion of Your Personal Data, or withdrawal of consent for the processing of Personal Data, We shall not retain Your Personal Data if We no longer need it, and there is no legal requirement to retain the same. Do note that multiple legal bases may exist in parallel, and We may still have to retain certain data and information at any time. 

Use of consent manager: You are permitted to give, manage, review or withdraw Your consent provided to Us to process Your Personal Data through a ‘consent manager’ when available. A consent manager is an entity that is registered with the Data Protection Board of India. The consent manager is accountable to You and can assist You in providing or withdrawing Your consent which You provided to Us to process Your Personal Data, on Your behalf. Such consent managers must comply with the obligations imposed on them as may be prescribed by the Indian Central Government.

Right to nominate: You shall have the right to nominate any other individual, who shall, in the event of Your death or incapacity, exercise Your rights in relation to Your Personal Data, as per applicable law in India.

13.3 Your Duties

The applicable laws prescribe certain duties that You must adhere to. As part of Your duties, You need to ensure that You:

a) Adhere to all the applicable laws for the time being in force while exercising Your rights; 

b) Do not impersonate any other person at the time of providing Your Personal Data; 

c) Do not suppress any material information while providing Your Personal Data for any document, unique identifier, proof of identity or proof of address issued by the State or any of its instrumentalities; 

d) Do not register false or frivolous grievances or complaints with Us or the Data Protection Board of India; and

e) Furnish only verifiably authentic Information when exercising Your right to erasure.

13.4. Information belonging to persons with disabilities

The Site and Our Services are inclusive and cater to all persons, including persons with disabilities. For the purpose of this Policy, a person with disability refers to someone with long-term physical, mental, intellectual, or sensory impairment that may hinder their full and effective participation equally with others, but a person who is otherwise competent to contract. We will be happy to serve You and help You through the use of the Site.

13.5. Data Retention

We ensure that Your Personal Data, which is in Our possession or under Our control, is destroyed and/or anonymised as soon as per applicable law (if mandated) it is reasonable to assume that (i) the purpose for which that Personal Data was collected is no longer being served by the retention of such Personal Data; and (ii) retention is no longer necessary for any other reason including the applicable law.

By lodging a complaint, You agree to provide complete support to the grievance redressal officer and such reasonable information as may be sought from You. We aim to resolve the complaints as soon as possible. 

The grievance redressal officer shall acknowledge Your grievances, or complaints or concerns with respect to the Site or the Services, within 72 hours of receipt of the same and shall endeavour to redress the same at the earliest. 

If You have exhausted Your opportunity of redressing Your grievances concerning Your Personal Data with Us and You are not satisfied with the resolution, You may raise Your concern to the Data Protection Board of India. 

While You have the right to raise complaints with the Data Protection Board of India after exhausting Your remedy with Eat App You, please note that, registering false or frivolous complaints with the Data Protection Board is a punishable offence.
